By accessing and using any of the resources within the Premium.Coffee ecosystem, including but not limited to Premium.Coffee, Coffee.Community, and associated platforms, you expressly acknowledge and agree that:

• You have read, understood, and accepted all information published on the token documentation page at https://coffee.community/token/
• You assume full and sole responsibility for all risks associated with using these platforms
• You are solely liable for any losses, damages, or claims resulting from your use of these services
• Your continued use of any platform within the ecosystem constitutes ongoing acceptance of these terms

2. Eligibility

By using the Platforms, you confirm that:

• You are of legal age in your jurisdiction (at least 18 years old, or the age of majority where you live)
• You have the legal capacity to enter into these terms
• Your participation does not violate any applicable laws in your jurisdiction
• You are not located in a restricted jurisdiction (see Section 11)

3. Not an Investment

• $COFFEE is a utility token used for cashback, governance, and rewards within the ecosystem
• Gratitude NFT is a digital collectible and token of appreciation for supporting the project
• Neither token nor NFT is an investment product or security
• No financial returns, dividends, or guaranteed benefits are promised

4. Token & NFT Risks

• Value Volatility: The market value of $COFFEE and NFTs may fluctuate and could drop to zero
• Regulatory Uncertainty: Cryptocurrency regulations are evolving globally and may impact token functionality
• Technical Risks: Smart contracts, wallets, and marketplaces may have vulnerabilities
• Irreversible Transactions: Blockchain transactions cannot be reversed — double-check all wallet addresses
• Burn Option: Burning an NFT for 100,000 $COFFEE is a one-time, irreversible action

5. Agent & Ambassador Program

• Revenue Share: Agents earn 15% (or 20% with NFT) from coffeehouse payments — this is a partner reward for active participation
• Not Guaranteed Income: Revenue share depends on coffeehouse retention and payments
• Ambassador Resale: NFT resale is at your own discretion — we do not guarantee liquidity or profit
• No Employment: Agents and ambassadors are independent partners, not employees

6. Roles, Responsibilities & Independence

Independent Coffeehouses

Premium.Coffee operates as a network of independent coffeehouses, not as a franchise, chain, or centralized operator. Each partner coffeehouse:

• Sets its own loyalty rules, rewards, and promotional offers
• Manages its own customer relationships
• Retains ownership of its customer data (within the limits described below)
• Operates independently and is solely responsible for its products and services

Customer Data

Each coffeehouse has access only to data related to its own loyalty program, including:

• Customer names and email addresses
• Activity within its own program (points, redemptions, visits)
• Communication preferences

A coffeehouse cannot access customer data from other, unrelated coffeehouses in the network. Premium.Coffee does not sell or share customer data across businesses.

Platform Role

Premium.Coffee provides:

• The technical platform (web app, QR codes, loyalty infrastructure)
• The crypto rewards infrastructure ($COFFEE, Bitcoin giveaways)
• The network and collective marketing

Premium.Coffee does not:

• Control individual coffeehouse loyalty programs
• Guarantee the quality, availability, or terms of coffeehouse offers
• Act as a party to transactions between customers and coffeehouses

Customer Choice

Customers may choose how to redeem their Coffee Points:

• Redeem at the coffeehouse — subject to each coffeehouse's own terms
• Swap for $COFFEE tokens — subject to platform rules and applicable regulations

Reward availability, expiration, and terms are determined by each individual coffeehouse. Premium.Coffee is not responsible for coffeehouse-specific reward policies.

Variation of Offers

Loyalty offers, reward types, and point values may vary between coffeehouses and may change over time. Customers should check the details on their loyalty card or ask the coffeehouse staff for the most current terms.

7. Information Published on Our Ecosystem

The websites and applications within the Premium.Coffee ecosystem provide information and material of a general nature.

8. Risks Related to Platform Use

The Platforms and their operators will not be responsible for any losses, damages, or claims arising from events including but not limited to:

• User mistakes: Forgotten passwords, payments sent to wrong addresses, accidental deletion of wallets
• Software problems: Corrupted wallet files, incorrectly constructed transactions, unsafe cryptographic libraries, malware
• Technical failures: Data loss due to faulty or damaged storage devices
• Security problems: Unauthorized access to users' wallets and/or accounts
• Third-party actions: Bankruptcy of service providers, information security attacks, fraud conducted by third parties

9. Privacy & Data Protection

We take your privacy seriously. Key points:

• Data we collect: Email address (for account), device information, activity within the ecosystem
• How we use it: To provide the service, send rewards, and improve the platform
• Data sharing: We do not sell your data. Coffeehouses see only their own program data
• Your rights: You can export your data, delete your account, or disconnect from individual businesses at any time
• Security: We use passwordless login and HTTPS encryption to protect your account

10. Translations

The Platforms may contain translations of the English version of the content. These translations are provided only as a convenience. In the event of any conflict between the English language version and the translated version, the English language version shall take precedence.

11. Geographic Restrictions

The Platforms are not available in jurisdictions where prohibited by international sanctions or local legislation, including:

• North Korea, Iran, Syria, Cuba, Afghanistan
• The Russian Federation, Belarus
• Ukrainian territories of Crimea, Donetsk, and Luhansk regions
• Venezuela, Myanmar, Sudan, Libya, Yemen, Zimbabwe
• Bosnia and Herzegovina, the Central African Republic
• The Democratic Republic of the Congo, Mali, Somalia, South Sudan

By using the Platforms, you confirm that you are not located in any of these jurisdictions.

12. Sponsored Content & Advertisements

The Platforms may feature sponsored content and advertisements. This content is marked appropriately to indicate that the visitor is viewing sponsored content where applicable.

13. Compliance with Tax Obligations

Users of the Platforms are solely responsible for determining what taxes, if any, apply to their transactions within the ecosystem. The Platforms, their operators, and token holders are NOT responsible for determining the taxes that apply to user transactions or any income derived from platform usage.

14. No Warranties

The Platforms are provided on an "as is" and "as available" basis without any warranties of any kind regarding the Platforms, content, data, materials, and/or services provided.

15. Limitation of Liability

Unless otherwise required by law, in no event shall the owners, operators, contributors, or token holders of the Platforms be liable for any damages of any kind, including, but not limited to, loss of use, loss of profits, or loss of data arising out of or in any way connected with the use of the Platforms.

16. Arbitration & Governing Law

By using the Platforms, you agree to arbitrate any dispute arising from or in connection with the Platforms or this disclaimer, except for disputes related to intellectual property rights including copyrights, logos, trademarks, trade names, trade secrets, or patents.

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Premium.Coffee operates, without regard to its conflict of law provisions.

17. Changes to Terms

We reserve the right to update this Legal Disclaimer at any time. When we make significant changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify users via email or through the platform where appropriate
• Provide a summary of key changes when significant

Continued use of the Platforms after changes constitutes acceptance of the updated terms. We encourage you to review this page periodically.

18. Entire Agreement

This Legal Disclaimer, together with the Privacy Policy and any other legal documents referenced herein, constitutes the entire agreement between you and Premium.Coffee regarding the use of the Platforms.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
